3. User Accounts

  • Permission to backup and restore your content for service continuity

Content Responsibility

You are solely responsible for:

Content Monitoring

While we don't actively monitor user content, we reserve the right to:

6. Intellectual Property

User Rights

Restrictions

7. Payment Terms

Billing and Payments

  • Billing Cycle: Subscriptions are billed monthly or annually

Refunds and Cancellations

Failed Payments

  • Limit service during high-traffic periods

  • Cloud hosting and infrastructure providers
  • Payment processing services
  • Analytics and monitoring tools

Service disruptions by these third parties may affect ZingLime's functionality.

9. Termination

Termination by You

You may terminate your account at any time by:

  • Cancelling your subscription through your account settings
  • Contacting our support team
  • Following the cancellation process in our app

Termination by ZingLime

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Fail to pay required fees
  • Engage in fraudulent or illegal activities
  • Abuse or misuse our service
  • Violate third-party platform policies

Effect of Termination

Upon termination:

  • Your access to ZingLime will be immediately suspended
  • Scheduled posts may not be published
  • Your data will be retained for 30 days for potential recovery
  • After 30 days, your data will be permanently deleted
  • You remain liable for all fees incurred before termination

10. Disclaimers

ZingLime is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, including:

  • Merchantability: The service may not meet your specific needs
  • Fitness for Purpose: No guarantee the service will achieve your goals
  • Non-Infringement: We don't warrant against third-party claims
  • Accuracy: Information and analytics may contain errors
  • Reliability: Service may be interrupted or unavailable

We do not guarantee that:

  • The service will be error-free or uninterrupted
  • Defects will be corrected
  • The service is free of viruses or harmful components
  • Results from using the service will meet your expectations

11. Limitation of Liability

To the maximum extent permitted by law, ZingLime shall not be liable for:

Excluded Damages

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Cost of substitute services
  • Damages arising from third-party actions

Liability Cap

Our total liability for any claims arising from or related to these terms or your use of ZingLime shall not exceed:

  • The amount you paid to ZingLime in the 12 months preceding the claim, or
  • $100, whichever is greater

Exceptions

These limitations don't apply to:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Violations of applicable law that cannot be limited

12. Indemnification

You agree to indemnify, defend, and hold harmless ZingLime, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of ZingLime in violation of these terms
  • Your content or activities on the platform
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations
  • Any false or misleading information you provide

This indemnification obligation survives termination of your account and these terms.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these terms or your use of ZingLime shall be resolved through:

  • Informal Resolution: First, contact us to resolve the dispute informally
  • Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
  • Class Action Waiver: You waive the right to participate in class action lawsuits
  • Jurisdiction: Courts in San Francisco, California have exclusive jurisdiction

14. Changes to Terms

We may update these Terms of Service from time to time. When we make changes:

  • We'll post the updated terms on this page
  • We'll update the "Last updated" date
  • For material changes, we'll notify you via email or in-app notification
  • Changes become effective 30 days after posting
  • Your continued use constitutes acceptance of the new terms

If you don't agree to the updated terms, you must stop using ZingLime and may terminate your account.
